Jane Fonda was never tried for treason for her traitorous act in North Vietnam in 1972, for a couple of reasons. One was her famous father, Henry Fonda, who was a WWII veteran and a Democrat. The other reason was that the Vietnam war was not a “declared” war by Congress.
Both reasons for not trying Jane for treason are questionable. Who her father was and whatever his political affiliation, should have no bearing on Jane’s prosecution for betraying our country. No matter what the leftist verbal contortionists would say about our military actions in Vietnam, it was a war by any definition of that word. Over 58,000 names on the Vietnam Veterans Wall bear witness to that.
Article III, Section 3 of our Constitution states, “Treason against the United States, shall consist only in levying War against them, or adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same Act or on Confession in open Court.”
Nowhere in the Constitution does it say that Congress must declare a war before a traitor can be tried or convicted of treason. There is no statute of limitation on treason. Jane Fonda should be brought before a federal court for a very public prosecution. Justice for those Vietnam veterans who came back, and those on the wall, demand it. The Constitutional requirement of two witnesses is easily met as millions of Americans witnessed the films of Jane sitting on an anti-aircraft gun in the company of our North Vietnam enemies.
To return to the present, are there people today, during our current war with Iran, who are committing treason? Certainly, anyone participating in the anti American/pro current Iranian government groups like the National Solidarity Group for Iran are providing “aide and comfort” for our enemies in Iran. Marching with signs that are not only anti American, but anti Semitic, should meet that requirement. It would not be surprising if an investigation proved that some of these groups were sending money to our enemies in Iran or receiving money from them. While billionaires like George Soros are probably layered with too much intermediary insolation to be charged with treason, his traitorous connections should be exposed and widely publicized.
In addition, all 53 Democrat Congressmen in the House who voted not to recertify Iran as a terror state should be named and targeted by political ads during their reelection campaigns. If their votes don’t give “aid and comfort” to Iran, nothing does. It’s not very likely that their votes on that issue could be prosecuted for treason. However, exposure of their traitorous vote at a time of war, would at least give a “jury” of their district voters the info they need to end their political careers.
Freedom of speech gives us all the right to criticize this or any other war while we are engaged in the waging of it. Our Constitution expressly does NOT endow the right to levee war against our country or adhere to our enemies by giving them aid and comfort.
