If your case is complicated and cannot be resolved outside of court, you will likely pay the 40% fee. So, if you recover $1 million in compensation, you will pay $400,000 to your lawyer. This amount is very steep and, in some cases, more than the lawyer would have charged per hour.

You may also have to cover some expenses even if your lawyer loses your case. These include filing fees or paying for the testimony of expert witnesses.

Also, keep in mind that contingency fees only apply to certain cases. If you pursue a personal injury claim, you can get a lawyer to work for a contingency fee. However, a criminal defense lawyer cannot work for a contingency fee.

Choosing a Contingency Lawyer for Your Case

If you want to file a medical malpractice, car accident, or wrongful death case, you will probably find a lawyer willing to handle it for a contingency fee. Again, the lawyer will only accept your case if there is a strong chance that they will win.

The first thing you want to do when searching for a lawyer is to do so in your area. It does not make sense to hire a lawyer in another city or state, especially if your accident or incident happened where you live. 

A local lawyer will have all the necessary experience and knowledge of local laws and regulations to ensure you have a strong case. 

When you have narrowed your choices, you should do some research via each firm’s website. You will find a lot of information on these websites, including areas of expertise and credentials. Most importantly, you will find client reviews and testimonials. 

However, do not only read the reviews on these websites. Look for Google or Yelp reviews to get a good idea of other clients’ experiences with these firms. 

When you are ready to decide, schedule a consultation with the lawyer (or more than one). A face-to-face meeting will allow the lawyer to review your case and determine whether you can get compensation. 

At the same time, you can ask questions about the legal process and your rights in your specific situation. Ensure the lawyer works on contingency, and do not forget to ask about the firm’s fee structure. 





Communication Is Key

You must be comfortable with how a lawyer communicates with you. You can use your initial consultation to determine whether you can get along with the lawyer.

If the lawyer intently listens while you speak and presents your legal options in a way you can understand, they will likely be a good communicator. You need them to update you on the progress of your case and be honest about all aspects of it. You want to avoid being in a situation where you hear nothing from your lawyer for weeks and have to guess what is happening.  

Filing a Legal Case

Hiring a lawyer, whether on a contingency basis or not, is not the first step in pursuing a personal injury claim (or wrongful death lawsuit). 

The first thing you need to do after being injured, whether in an accident or through medical malpractice, is to seek treatment. If you do not receive any treatment or at least a medical evaluation, it will instantly weaken the case you have not even filed yet. 

When you have your medical records, you can find a lawyer (using the steps above). Your lawyer will help you file your claim after getting the necessary evidence from you and doing their investigation. 

When your lawyer has all the necessary information and evidence, they will demand compensation. This demand will go to the responsible individual or their insurance company. The lawyer can make this demand before or after filing your lawsuit. 

Your lawyer will then actively participate in the negotiation process to ensure you get the settlement you deserve. If the lawyer and the insurance provider (or at-fault party) cannot reach a settlement agreement, your lawyer will prepare your case for trial. Your evidence will be presented in court, and a jury or judge will decide on your compensation.
