November 13, 2018 CHINO VALLEY, AZ- The Chino Valley Town Council unanimously adopted Ordinance 18- 859, amending the current Town traffic code (chapter 71) by adding a new section, 71.14, to cover the use of portable communication and electronic devices.
The decision, made at the November 13, 2018 Council Meeting, followed an October 23, 2018 presentation by Chief Chuck Wynn of the Chino Valley Police Dept. that outlined the ordinance. The October presentation came soon after the Yavapai County Board of Supervisors passed a similar county ordinance that went into effect earlier this month.
The Chino Valley ordinance will not go into effect until January 1, 2019. Wynn stated that an intense educational campaign will begin soon to inform the public on the specifics of the new ordinance.
Traffic code chapter 71, section 71.14 section B states, in part, that “No person shall, except as otherwise provided in this section, use a mobile communication device while operating a motor vehicle upon a street or highway, unless that device is specifically designed or configured to allow hands-free use and is used in that manner while operating a motor vehicle.”
Several exemptions are listed, including some emergency services, fire, police, and medical personnel provisions, as well as when operating a vehicle on private property.
Penalties for violating the new law may include a $125.00 fine, $250.00 if a person is found to be in violation of the section and involved in a motor vehicle accident. These fines may also be in addition to other penalties or assessments authorized by law.
